1. Acceptance Of Terms

By accessing this website or submitting any form on it, including the Contact Us form and the Careers application form, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and any applicable law, including the Digital Personal Data Protection Act, 2023 and its rules. If you do not agree with any part of these terms, please do not submit your information through this website.

2. Why We Collect Your Data

We only collect personal data that is necessary to respond to the specific request you make. We do not collect any data from you unless you voluntarily submit it through one of our forms.

2.1 Contact Us Form

When you submit an enquiry through our Contact Us form, we collect your name, phone number, email address, area of interest, and message. This data is collected and used solely to:

• Understand and respond to your B2B trade, wholesale, or sourcing enquiry.
• Get in touch with you by phone or email regarding your request.
• Maintain a record of business enquiries for follow-up and quality of service.

2.2 Careers / Job Application Form

When you apply for a position through our Careers page, we collect your name, phone number, email address, work experience, current location, educational qualification, cover note, and your uploaded resume/CV document. This data is collected and used solely to:

• Evaluate your suitability for the position you have applied for.
• Contact you regarding the status of your application, interviews, or offers.
• Maintain recruitment records for hiring and compliance purposes.

We do not use data submitted through either form for marketing to third parties, and we do not collect any personal data through this website beyond what you voluntarily provide in these two forms.

3. Consent & Lawful Basis For Processing

In accordance with Section 4, 6 and 7 of the DPDP Act, 2023, we process your personal data only on the basis of your free, specific, informed, and unambiguous consent, given by the clear affirmative act of filling in and submitting the relevant form.

You have the right to withdraw your consent at any time, with the same ease with which it was given, by writing to us at the email address mentioned in Section 9 below. Withdrawal of consent will not affect the lawfulness of any processing carried out before such withdrawal, and may result in us being unable to process an ongoing enquiry or job application.

4. Purpose Limitation & Data Minimisation

As required under Section 4(2) of the DPDP Act, 2023, we collect only the personal data that is necessary for the specific, lawful purpose stated at the time of collection — that is, responding to your trade enquiry or evaluating your job application. We do not use this data for any other purpose without seeking your fresh consent.

5. Data Storage & Retention

Information submitted through our Contact form and Careers application form is transmitted by email to our authorised business and HR email accounts for review and response. We retain this data only for as long as is necessary to fulfil the purpose for which it was collected, namely:

• Contact enquiries are retained until the enquiry is resolved and for a reasonable period thereafter for record-keeping.
• Job application data, including resumes, is retained for the duration of the recruitment process and for a reasonable period thereafter in case the profile is relevant to future openings.

You may request erasure of your data at any time as described in Section 7 below, and we will delete it unless we are required to retain it under any applicable law.

6. Disclosure & Sharing Of Data

We do not sell, rent, or trade your personal data to any third party. Data submitted through our forms is accessed only by authorised personnel of BrandBuys Global Trade Private Limited who need it to respond to your enquiry or process your job application.

We may share your data with a data processor (such as an email or hosting service provider) strictly to the extent necessary to operate this website and deliver your submission to us, and only under a valid agreement requiring that processor to protect your data in line with the DPDP Act, 2023. We may also disclose data where required by law, regulation, court order, or a lawful request from a government authority.

7. Your Rights As A Data Principal

As a Data Principal under the DPDP Act, 2023, you have the following rights in relation to the personal data we hold about you:

• Right to Access: Request a summary of the personal data we hold about you and the processing activities carried out on it.
• Right to Correction & Updating: Request correction of inaccurate or misleading data, and updating of incomplete data.
• Right to Erasure: Request deletion of your personal data once it is no longer necessary for the purpose it was collected, unless retention is required by law.
• Right to Withdraw Consent: Withdraw your consent for processing at any time, as described in Section 3.
• Right to Grievance Redressal: Raise a grievance regarding the manner in which your personal data is being processed, as described in Section 9.
• Right to Nominate: Nominate another individual to exercise these rights on your behalf in the event of your death or incapacity.

In line with Section 8(5) of the DPDP Act, 2023, we take reasonable technical and organisational measures to protect personal data submitted through this website from unauthorised access, disclosure, alteration, or loss, including restricting access to submitted data to authorised personnel only. In the unlikely event of a personal data breach, we will take steps to notify the Data Protection Board of India and affected users as required under the Act.

We will acknowledge and address your grievance within the timeline prescribed under the DPDP Act, 2023.

10. Children's Data

Our Contact and Careers forms are intended for use by individuals of legal working age and are not directed at children. We do not knowingly collect personal data from individuals below the age of 18. If we become aware that a child's data has been submitted without appropriate consent, we will delete it promptly.

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts at Patna, Bihar.
